Employment Discrimination
We have successfully represented a number of employees who have been victimized my employment discrimination. Among those we have represented is a professional accountant of Asian heritage who alleged that he suffered from discriminatory treatment and ultimately wrongful dismissal. We achieved a settlement for client based upon his loss of past and future compensation.
We represented a highly qualified woman who claimed discriminatory treatment and ultimately wrongful termination by a large investment bank. After extensive discovery which supported her claims of discriminatory treatment and hostile work environment, we were able to achieve a substantial settlement.
We successfully represented a former bank employee who had been dismissed allegedly as a result of both age and disability discrimination, as well as a former law firm employee who alleged he had been retaliated against for reporting discrimination faced by another. Both cases resulted in satisfactory settlements.
Consumer Class Actions
We have represented a number of consumers in successful class actions alleging fraud and deceptive practices by companies both large and small. Class actions are lawsuits where one or more people represent a large group of others injured in the same way. All of the cases below resulted in the Plaintiff and the class members being compensated for their injuries.
We have received a settlement on behalf of purchasers of computers and “Palm Pilot” remote communication devices who found that their computer hard drives were destroyed after being connected to the “Palm” communication devices.
We have successfully represented telephone subscribers who found that their telephone numbers were revealed to users of caller ID services not withstanding a promise by the telephone company to keep those subscribers numbers confidential.
We have successfully represented a group of tenants of assisted living facilities who had been overcharged for their rent and housing services.
We have represented purchasers of memberships in timeshare camp ground resorts who have alleged that did not receive the type or quality of service for which they had contracted. The action resulted in a substantial settlement and refunds for the camp ground purchasers.
In several cases where we represented consumers who were misled by deceptive advertising, we not only recovered damages for injured consumers but achieved legally binding settlements which required that advertisers accurately describe the product and services that they were marketing.
We successfully represented a large group of cell phone subscribers who were the victims of a deceptive pricing scheme pursuant to which they charged for minutes that should have been provided without additional charge.
We have represented customers of credit counseling organizations that have allegedly utilized fraudulent and deceptive practices to attract customers who did not receive the benefits of lower interest rates, better payment terms and real assistance in getting out of debt.
Medical Malpractice
We represented a man in his late 50s who suffered a severe stroke resulting in partial paralysis and impairment of both speech and physical capabilities. Out client had visited his internist physician and complained of temporary loss of vision after being in bright sunlight. Before seeing his internist he had consulted an ophthalmologist who did not find any permanent limitation of vision. However she recommended that our client’s internist perform a series of tests to ascertain whether he had suffered a temporary aschemic attack (TIA). Notwithstanding the recommendations of the ophthalmologist, our client’s internist did not perform any of the recommended tests.
Shortly after our client had been examined by his internist, he suffered a massive stroke and it was determined that his carotid artery was almost entirely blocked. The blockage of the carotid artery would almost certainly have been discovered had the appropriate tests been performed. After extensive discovery, the case was settled prior to trial with a substantial six (6) figure settlement.
We have represented a number of individuals who suffered impairment of vision after undergoing a Lasik correction procedure. Lasik is a procedure which corrects and improves an individual’s vision with the use of a laser to alter the shape of a patient’s cornea. While most individuals are good candidates for Lasik, there are certain contraindications which, if ignored, can result deteriorated vision and other complications. We have successfully represented a number of injured former Lasik patients and achieved both a jury verdict in favor of a plaintiff and a number of successful settlements.
We recently represented a woman burned on her side during the course of her back surgery. She suffered some temporary pain and scarring. Though litigated in a county not known for favoring plaintiffs, our client received a fair settlement.
Automobile Accidents
Over the years, we have represented a number of individuals injured in automobile and other accidents. We have represented a woman was severely injured after being struck by a bicycle delivery man. We have represented an elderly gentleman who was severely injured when struck by an automobile while crossing the street. Both of these cases resulted in favorable settlements.
Corporate Business Litigation
We have also represented a number of businesses, both large and small, in connection with injuries they suffered in the course of doing business. We represented a computer service which had a substantial contract to provide a comprehensive business distribution monitoring system. Though most of the developmental work was completed, our client’s contract was terminated and the purchaser system used our client’s software and confidential information to complete their installation. Our client received a substantial settlement in the midst of a trial.
We’ve represented investors who have found that their investments had been diverted to purposes not agreed upon when they invested their money and as a result lost substantial investments. The actions have resulted substantial settlements.
Our office has also successfully enforced judgments on behalf of a client whose licensing rights were being violated. In addition to obtaining settlements from some offenders, one establishment was closed by the city marshal until such time as payments were made.
We have also represented a number of businesses that had been the subject of regulatory action by various government agencies. Such representation has resulted in settlements in which we have been able to negotiate agreements with the regulatory agencies that successfully resolved investigations and enforcement actions. We’ve represented investors in both individual stock fraud actions and as co-counsel in a number of securities fraud class actions.
In addition, we have defended both corporations and individuals who have been sued for alleged breach of contract or other business misconduct. Recently, we successfully defended a group of investors in a restaurant who were sued by their fellow investors, and an investor in an investment fund sued by the trustee of that fund.
Personal Representation
Our firm also represents and has represented a variety of individuals in personal matters, from large to small. Representations include property damage actions brought in both the Supreme and Civil courts (which resulted in successful trial verdicts and settlements respectively), construction disputes, disputes over estates and trust matters and the sale and purchase of real property. We have also represented business owners in the purchase and sale of their businesses.
